A 66-year-old Marshfield man and a woman were injured in a Plymouth County accident involving a collision between a motorcycle and a car. According to a WATD news report, the motorcycle crash occurred on Ocean Street near the police station in Marshfield. Officials say the male rider was injured when his motorcycle struck a car that was backing out of a driveway. The motorcyclist was flown to Beth Israel Deaconess Hospital in Boston and the female driver was taken by ambulance to Beth Israel in Plymouth. It is unclear if the driver will be cited for the crash.

Whenever someone is injured in a Massachusetts motorcycle accident, it must be determined who was at fault and who had the right of way. When an accident occurs near a private drive, it is common for the at-fault driver to be the one pulling into or out of the driveway. Drivers who are turning, or entering traffic, must yield to approaching motorists.

For example, under Boston Article VI, Section 22: “The driver of a vehicle emerging from a private road, driveway, or garage, shall stop such vehicle immediately prior to driving upon the sidewalk area extending across such driveway or garage, and where no such sidewalk exists, the stop shall be made at the building or property line as the case may be. Upon entering the roadway the driver shall yield the right-of-way to vehicles approaching on the roadway.”

Motorcyclists in Massachusetts may file a personal injury claim to receive compensation for damages including medical expenses, lost wages, loss of earning potential, pain and suffering, cost of rehabilitation, property damage and other losses. However, it can be a challenge for injured motorcyclists to prove fault and liability. This is why it is important to gather as much evidence as possible from the scene and obtain prompt medical attention so that the victim’s injuries are properly documented. An experienced Boston motorcycle accident lawyer will help injured victims and their families better understand their legal rights and options.
